La gestion du risque : de l'approche juridique à l'ébauche d'une méthodologie managériale

Abstract : Over the last fifty years, the proliferation of legal provisions aiming at controlling any risk whether it be technological, environmental or natural risks, occupational and health hazards or food safety, has- despite the apparent heterogeneity of the regulations- paved the way to the emergence of general principles reflecting a genuine legal methodology of risk management. This methodology is likely to apply to business risks management. Based on a logic-based approach to analysis and management, being a probabilistic approach, its main aim is the comprehensiveness of risk identification, the relevance of risk analysis and the proportionality of risk management. It might be transferred to business risks management. In addition, this approach is always in line with a finalized process. The analysis, which is pursued as a matter of priority by the person or authority responsible for risk control, is subject to a broad consultation with all the people involved in risk. A similar process has to find its own place in a business risk management policy. Such involvement together with the sharing of knowledge and information is a key to tight and efficient management ; it contributes to the long-sought-after emergence of a culture that will promote safety and a society’s ability to manage risk and contribute to reach the goals set by companies.
