Feu la jurisprudence “Rekhou”. À propos de l’arrêt d’Assemblée du Conseil d’État du 9 juillet 2010 “Mme Cheriet-Benseghir”

Abstract : Reversing its Rekhou precedent, the “Conseil d’Etat” will accept from now on to appreciate whether the condition of reciprocity established by the article 55 of the Constitution is fulfilled. This solution, adopted to bring french law in keeping with the requirements of the ECHR, may appear as a progress: it reinforces the right to a fair trial. However, the solution also creates some problems. Beside the fact that it might be difficult in practice for courts to appreciate if the treaty is effectively enforced by a foreign country, it forces the judge to cross the boundary between justice and diplomacy, a line that our judiciary have traditionally tried to maintain.
