De la subordination à la domination du salarié : la « preuve sociologique » par le temps de travail

Abstract : This article focuses on the legal implications of the recent changes in wage labor. From a basis in the sociological studies of the Toyota model, it explores the multiple normative means used to establish a clear domination by workers of working hours, under the cover of increasing autonomy and responsibility (exception to the legal length of working hours, yearly calculation of working hours, day-based count of work time, overtime, new articulation of norms). The article then suggests that side by side with a subordinate position, a new criteria qualifying the work contract, that of a dominate position, was introduced that would reestablish a systematic legal control over the legitimacy of working conditions.
