Droit souple + droit fluide = droit liquide : Réflexion sur les mutations de la normativité juridique à l’ère des flux

Abstract : It is submitted that the increasingly widespread use of soft law by public authorities reflects the desire for light and fluid legal normativity. There is a relationship of creative complementarity between soft law and fluid law. This hypothesis comes along with the three following claims. Soft law is a law that seeks fluidity through the relaxation of its texture. Fluid law is a law that operates through normative flows and increasingly in massive flows of flexible law. Soft law and the imperative of legal fluidity work together to generate a general fluidification of legal normativity fostering a liberalisation of activities. These combined processes of relaxing the texture of legal normativity and of socio-economic fluidification of the norms’ content contribute to the emergence of the liquid law image
